Medivaco operates as a digital marketplace and concierge facilitator. We are a private commercial entity — we are not affiliated with, endorsed by, or an agent of any Indian government body, the Indian Council of Medical Research (ICMR), the Medical Council of India (MCI/NMC), or any public health authority.

Individual outcomes vary significantly based on patient age, health status, complexity of condition, comorbidities, compliance with post-operative care, and many other factors. No outcomes data on this website constitutes a guarantee of any individual result.
Cost estimates provided by Medivaco (whether on our website, in communications, or in written estimates) are indicative only and do not constitute binding quotations. Actual hospital costs depend on specific clinical findings, complications, extended stays, additional procedures, implant choices, and other factors that can only be confirmed by the treating hospital following clinical assessment. All formal cost quotations are issued directly by the partner hospital.
Our services are not designed for medical emergencies. If you are experiencing a medical emergency, contact emergency services in your country immediately. Do not use our website or contact forms in place of emergency medical assistance.
Medivaco charges facilitation service fees for the coordination and support services we provide. These fees are separate from and in addition to any fees charged directly by hospitals, doctors, diagnostic centres, accommodation providers, or other third parties. Our fee structure is communicated to you at the time of engagement and before any commitment to pay is required.
In some cases, Medivaco operates on a commission or referral fee basis payable by partner hospitals, in which case our facilitation services may be provided to patients at no direct charge. The applicable model will be disclosed to you clearly.
Payments for medical treatment, diagnostic tests, and hospital services are made directly to the relevant Indian hospital or healthcare provider. Medivaco does not collect payment on behalf of hospitals unless acting as an authorised payment agent for a specific transaction, in which case this arrangement will be documented in writing.
Medivaco accepts payment via international bank wire transfer (SWIFT), credit and debit cards (via approved payment gateways), and such other methods as communicated at the time of billing. All payments must be in the currency agreed at the time of engagement.
Where payments are made in foreign currency (USD, GBP, EUR, AED, or other), exchange rates are determined by the prevailing rate at the time of transaction. Medivaco is not responsible for currency fluctuations that affect the Indian Rupee equivalent of your payment. Cost estimates in INR may differ in foreign currency terms due to exchange rate movements.
Depending on your country of residence, payments made to Medivaco may be subject to withholding tax under a Double Taxation Avoidance Agreement (DTAA) between India and your country. It is your responsibility to understand and comply with your domestic tax obligations regarding payments made to Indian entities. Medivaco will provide all documentation required for your tax compliance upon request.
All international payments received by Medivaco are received in compliance with the Foreign Exchange Management Act (FEMA), 1999, and RBI regulations. International patients should ensure their outward remittances comply with the regulations of their home country.
Medivaco is registered for Goods and Services Tax (GST) in India. The following GST treatment applies to our services:

GST invoices will be issued for all taxable services. The applicable GST amount, if any, will be specified in your cost estimate and invoice. You are responsible for any indirect tax obligations in your own jurisdiction arising from services received from Medivaco.
Cancellation of facilitation services by the user is subject to the following policy:
Cancellation and refund policies for hospital fees, surgical deposits, and treatment costs are governed entirely by the relevant hospital’s own policies. Medivaco will assist you in communicating with the hospital regarding cancellations but cannot guarantee refunds of hospital fees. Review the hospital’s cancellation policy before paying any deposits.
Refunds for flights, hotel bookings, and other travel arrangements are subject to the policies of the relevant airline, hotel, or travel provider. Medivaco is not liable for any non-refundable travel costs incurred in connection with a cancelled or postponed medical trip.
Medivaco reserves the right to cancel or suspend facilitation services if: (a) you provide false or misleading information; (b) your medical condition makes travel to India unsafe in the clinical opinion of the treating specialist; (c) you fail to make required payments; or (d) circumstances arise that make safe coordination of your treatment impossible. In cases of Medivaco-initiated cancellation for reasons other than user fault, a full refund of facilitation fees will be provided.

All content on the medivaco.com website — including text, blog articles, treatment guides, graphics, logos, icons, images, user interface design, and software — is the intellectual property of Medivaco Healthtech LLP or is used with the permission of its owners, and is protected by Indian and international copyright, trademark, and other intellectual property laws.
You are permitted to access and view our website content for your personal, non-commercial use in connection with evaluating and accessing our services. You may print or save pages for your personal reference.
Without Medivaco’s prior written consent, you may not:
When you submit medical documents, photographs, testimonials, or other content to Medivaco, you retain ownership of that content. You grant Medivaco a limited, non-exclusive licence to use that content solely for the purpose of providing facilitation services to you. We will not use your personal content for marketing purposes without your explicit separate consent.
This section significantly limits Medivaco’s legal liability. Please read it carefully.
Medivaco is expressly not liable for any medical outcomes, clinical complications, surgical errors, misdiagnosis, delayed diagnosis, medication errors, hospital-acquired infections, anaesthetic complications, or any other adverse medical event arising from treatment received at any partner hospital or from any medical professional. All medical liability rests with the treating hospital and medical professionals.
To the maximum extent permitted by applicable law, Medivaco’s aggregate liability to you for any claim arising from or related to our facilitation services shall not exceed the total facilitation fees actually paid by you to Medivaco in the 12 months preceding the event giving rise to the claim.
Medivaco shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of income or earnings during treatment and recovery, cost of flights or accommodation, cost of travel insurance, costs arising from treatment complications or extended hospital stays, emotional distress, or loss of opportunity — even if Medivaco had been advised of the possibility of such damages.
Medivaco is not liable for the acts, omissions, or defaults of any third-party service provider, including partner hospitals, hotels, airlines, transport providers, or diagnostic laboratories. Your recourse for dissatisfaction with these providers is directly against those providers.
Medivaco is not liable for any failure to perform or delay in performance caused by events outside our reasonable control (see Section 17).
Nothing in these Terms limits or excludes Medivaco’s liability for: fraud or fraudulent misrepresentation; death or personal injury caused directly by Medivaco’s proven negligence; or any liability that cannot be excluded or limited under applicable mandatory law (including applicable consumer protection law).
Some jurisdictions do not permit certain limitations of liability. If you are a consumer in such a jurisdiction (e.g., certain EU member states under consumer protection regulations), mandatory consumer rights applicable in your jurisdiction are not affected by these Terms.
You agree to indemnify, defend, and hold harmless Medivaco Healthtech LLP, its designated partners, managers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, penalties, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
Partner hospitals listed on our website are independent organisations. Their inclusion as Medivaco partners does not constitute a guarantee of quality, safety, or patient outcomes. Accreditation details (NABH, JCI) are as reported by the hospitals and are subject to change. We encourage patients to independently verify accreditation status with the relevant bodies.
Medivaco introduces you to hospitals and doctors but does not have an exclusive arrangement with any single institution. We aim to recommend the most appropriate option for your clinical and personal needs. Our partner hospitals may pay referral fees to Medivaco for introductions — this does not influence our clinical recommendation process, which is based on your medical needs.
We strongly recommend — and in some cases may require — that all international patients obtain comprehensive travel insurance before travelling to India for medical treatment. This insurance should cover: medical treatment abroad, emergency surgical complications, medical repatriation, trip cancellation, and loss of baggage. Medivaco does not sell or provide travel insurance and is not liable for any losses that adequate travel insurance would have covered.
Our website may contain links to third-party websites. These are provided for convenience and information only. Medivaco has no control over and assumes no responsibility for the content, privacy policies, or practices of any linked websites. Accessing third-party links is at your own risk.
Your privacy and the protection of your personal and medical data is of paramount importance to us. Our collection, use, storage, and sharing of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using our services, you acknowledge and consent to the processing of your personal data — including sensitive medical data — in accordance with our Privacy Policy. This includes the transfer of your data to India and to Indian healthcare institutions for the purposes of treatment facilitation.

Medivaco shall not be liable for any failure or delay in the performance of our services to the extent that such failure or delay is caused by or results from circumstances beyond our reasonable control, including but not limited to:
In the event of a force majeure, Medivaco will notify you as soon as reasonably practicable and will use reasonable efforts to find alternative arrangements. If a force majeure event continues for more than 60 days and materially prevents the delivery of the agreed services, either party may cancel the engagement with a pro-rata refund of facilitation fees for services not yet rendered.
These Terms of Use and any dispute, claim, or controversy arising out of or in connection with them or their subject matter or formation (including non-contractual disputes) shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Subject to Section 19 (Dispute Resolution), the courts of competent jurisdiction in Noida, Uttar Pradesh, India (or such other courts in India as may have jurisdiction by operation of law) shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.
Notwithstanding the above, if you are a consumer resident in the European Union, United Kingdom, Australia, or another jurisdiction where mandatory consumer protection laws apply, nothing in these Terms limits your statutory consumer rights under the applicable law of your jurisdiction. You may also have the right to bring proceedings in the courts of your country of habitual residence.
For all users accessing services from within India, these Terms are in addition to and shall be read alongside all applicable Indian statutes, including the Consumer Protection Act 2019, the Information Technology Act 2000, the Indian Contract Act 1872, and other applicable legislation.
In the event of any dispute, claim, or controversy between you and Medivaco arising from or relating to these Terms or our services, both parties agree to first attempt in good faith to resolve the matter through direct negotiation. You should contact us at [email protected] with a clear description of the dispute and your proposed resolution. We will acknowledge within 5 business days and respond substantively within 21 days.
If direct negotiation does not resolve the dispute within 45 days, both parties agree to attempt resolution through mediation under the Mediation Act 2023 (India) or another mutually agreed mediation process. The costs of mediation shall be borne equally unless otherwise agreed.
If mediation fails, any unresolved dispute shall be finally settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India), as amended. The seat and venue of arbitration shall be Noida, Uttar Pradesh, India. The proceedings shall be conducted in the English language. The arbitral award shall be final and binding on both parties.
Notwithstanding the above, either party may seek urgent injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration or mediation.
If you are a consumer resident in the European Union, you may also be entitled to use the EU Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. UK consumers may have access to alternative dispute resolution schemes under applicable UK legislation.
Medivaco reserves the right to modify or update these Terms at any time. Changes will be effective upon posting to our website with an updated “Last Updated” date. Where changes are material — particularly where they affect your rights or financial obligations — we will provide advance notice of at least 30 days via email to active patients and registered users where we hold valid email addresses.
Your continued use of our services after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must discontinue use of our services. Previous versions of these Terms are available upon written request.
We encourage you to review these Terms periodically to stay informed of any updates. The date of the most recent revision is always displayed at the top of this page.
